1. Acceptance of terms

By accessing or using wendys-menus.us (the “Site”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. Eligibility

The Site is a general-audience publication intended for readers aged thirteen and above. If you are between thirteen and the age of majority in your jurisdiction, you may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

3. Editorial content & licensing

All original text, photography, illustrations, data visualizations, and layout on the Site are the copyrighted work of the site operator or its contributors, protected under United States and international copyright law.

You may, without written permission:

• Link to any page on the Site;
• Quote up to two hundred (200) words of an article, provided you include a visible byline and a link back to the original article on wendys-menus.us;

Without our prior written permission, you may not:

• Re-host our photographs on any other website or service;

4. Reader submissions

When you send us reviews, story tips, corrections, or other content (“Submissions”), you represent that you own the content or have the right to send it, and you grant Wendy's Menu USA a worldwide, royalty-free, non-exclusive license to use, reproduce, adapt, and publish the Submission for editorial purposes, including in articles and social promotion of articles. We may edit Submissions for length, clarity, and style. You retain your underlying copyright.

5. Trademarks & fair use

“Wendy’s,” “Baconator,” “Frosty,” “Dave’s Single,” and related product names are registered trademarks of Wendy’s International, LLC. We reference these marks, in text and in our own editorial imagery, solely for commentary, news reporting, and consumer reviews, a use protected under U.S. nominative fair use doctrine and analogous provisions elsewhere. 6. Prohibited conduct

You agree not to:

• Circumvent, disable, or interfere with security or rate-limiting features;
• Access the Site through automated means without honoring our robots.txt and this section;
• Upload malware, execute injection attacks, or probe the Site for vulnerabilities without written authorization;
• Impersonate Wendy's Menu USA, an editor, or another person;
• Use the Site to defame, harass, or violate the rights of others.

7. Automated access, scraping & AI training

Automated crawling is permitted only for well-behaved search-engine crawlers that obey the directives in robots.txt. Bulk scraping, mirroring, or archiving of the Site is prohibited without written permission. Use of any content from the Site as training data, prompts, embeddings, retrieval-augmented context, or fine-tuning material for machine-learning systems is expressly prohibited. 8. Third-party links

The Site links to third-party websites for reader convenience. We do not control and are not responsible for the content, policies, or practices of third-party sites.

9. No warranties

To the fullest extent permitted by law, Wendy's Menu USA disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be error-free or uninterrupted. Prices, calorie counts, and menu information are editorial and may differ from what is offered at your specific restaurant location.

10. Limitation of liability

To the fullest extent permitted by law, Wendy's Menu USA, its editors, contributors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Site. Our total aggregate liability to you for any claim arising out of or relating to the Site is limited to one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Wendy's Menu USA and its editors, contributors, and service providers from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Site.

12. DMCA & copyright complaints

We respect intellectual-property rights. If you believe content on the Site infringes your copyright, send a notice to our designated agent that includes: (i) your physical or electronic signature; (ii) identification of the copyrighted work; (iii) the URL of the allegedly infringing material; (iv) your contact information; (v) a statement of good-faith belief that use is not authorized; and (vi) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the copyright owner’s behalf.

13. Termination

We may suspend or terminate access to the Site for any user who breaches these Terms or whose activity risks harm to the Site or its readers. You may stop using the Site at any time.

14. Governing law & venue

These Terms are governed by applicable law. Nothing in these Terms removes consumer rights that cannot legally be waived in your jurisdiction.

15. Dispute resolution & arbitration

Before filing any claim, you agree to first send a written description of the dispute to legal@wendys-menus.us and to attempt in good faith to resolve it informally within thirty (30) days. If informal resolution is unsuccessful, the remedies available under applicable law remain available to both parties.

16. Changes to these terms

We may update these Terms from time to time. Material changes take effect thirty (30) days after we post the revised Terms on this page. Continued use of the Site after that date constitutes acceptance of the revised Terms.

17. Miscellaneous

These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and Wendy's Menu USA regarding the Site. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger or sale of the publication.
